D.A. Won't Prosecute Lindsay in Betty Ford Case

The Riverside County District Attorney has decided not to file criminal charges against Lindsay Lohan in connection with the altercation last December between Lindsay and a Betty Ford staffer. The D.A. believes there is "insufficient evidence" to prosecute Lindsay.

Lohan was under investigation for battery after a scuffle with Dawn Holland, while there for treatment. The case involved an alleged altercation that happened after Lohan and her roommates left the clinic and came back from a bar at 1:03 A.M. on Dec. 12. The altercation is categorized as a "hand to hand battery."

The District Attorney claims the investigation was like any other and was not given special treatment. "It wasn't looked at any differently than other cases, and we didn't put any special priority on this," Hall said. "We also had to re-interview subsequent times several witnesses in the case."

Lindsay Lohan is Going to Trail

Lindsay met with her lawyer, Shawn Holley Tuesday afternoon.  Holley laid out the options but left the decision to Lindsay, who said she's firm about her innocence and wants to push it to the wall at trial.

Lindsay's felony grand theft case will now be assigned to Judge Stephanie Sautner who is considered a tough but fair judge and the preliminary hearing is set for April 22.

Lindsay faces both jail and prison as the case moves on jail,  if Judge Sautner decides Lindsay violated her probation, and prison, if Lindsay is convicted of grand theft.

We have been saying Lindsay was crazy not to accept the plea deal, not because she'd be found guilty of grand theft ... but the way the system is set up, Lindsay could be thrown in jail for the probation violation before her grand theft trial.

Here's the good news for Lindsay.  If she had accepted a plea deal, she would have been placed on 3 years probation. Lindsay has a credible defense in the grand theft case, and if Judge Sautner agrees NOT to rule on the probation violation until a verdict is reached in the grand theft case, Lindsay could get off with no time served.

Lindsay Lohan Late for Court and Decision Put On Hold

Lindsay Lohan is late for court! What a surprise this is! Her driver is rolling through stop signs while paparazzi on bicycles try to get pictures while she jums on the freeway. Apparently the courthouse is alright with her being late although her judge has said in the past, "Watch your step, I'm going to treat you like I treat everyone else". Let's see if this going to prove to be true.

LiLo arrives in a camel fitting long sleeved dress, more conservative than some of her past choices with Chanel shoes and Dior shades today. . "Who are you wearing?" someone yells out, of course she's not going to answer you, idiot.

It's absolutely insane that we care so much about Lindsay Lohan getting to court that FOX News had a sky cam following her. "Lindsay Lohan Court Arrival" is labeled "Breaking News". I suppose it was a slow news day.

So let's get down to business... The sentencing recommendation, even though Judge Keith Schwartz wanted it held confidential will probably end up in having Lohan spend 3 months in jail , but he has given Lindsay more time to mull over his offer.

The judge has sent the case to another judge -- Stephanie Sautner -- Lindsay will be back in court before Judge Schwartz on March 25, and she can plead either guilty or no contest to the grand theft charge.

If Lindsay doesn't accept the plea, Judge Sautner will hold a preliminary hearing on April 22.  At the same time Judge Sautner will decide if Lindsay violated her probation -- and it's virtually a sure bet the judge will rule Lindsay did indeed violate it.  At that point Lindsay will go to jail as she awaits trial.
Hang in there Lins- We are all cheering for you...or at least watching you.

Lindsay Upset With 'SNL' Over Miley's Insults

Lindsay Lohan has sent a letter to "Saturday Night Live" producer Lorne Michaels saying she was disappointed with him for allowing Miley Cyrus to take pop shots at her on the show, coming from someone who took a shot at herself during a Jimmy Kimmel skit on his show after the Oscars.

Lindsay felt betrayed that he would let Miley mock her on TV so LiLo sent an email to let him know she was upset, she considered LM a mentor.javascript:void(0)

Miley finished her opening monologue with a musical number which included the lyric, "I never stole a necklace or got a DUI .. never cheated on wife like that golfer guy ... so what if you can see a little boob from the side ... I'm sorry if I'm not perfect." No one is perfect and if you can't make fun of yourself or someone else than what is the world coming too! Lighten up LiLo you have had you turn at poking fun at other stars on SNL yourself!

Lindsay Lohan's surveillance Video is Sold...Prosecutor NOT HAPPY!

The Kamofie & Co "the victim" in the alleged Lindsay Lohan jewelry store heist just sold the surveillance video which probably may have really messed up the prosecutor's case.

Were told the the store owner has been working with a broker for the last few days and the broker has been in touch with numerous media outlets.

The video has been sold -- but it's causing an uproar for the lawyers in the case, especialy the prosecutor.

Lindsay's defense is that the necklace was a loan ... the jeweler begged to differ. So intent is critical, and if the jeweler is called to the stand and it somehow turns into a convenient way of scoring some quick cash from the media, the case could close on this situation real quick.

So why did Kamofie sell the tape especially when the lawyers in the case have been in touch with the them, trying to dissuade them from selling it?

We will see how this will affect plea bargain negotiations. Shawn Holley, Lindsay's lawyer, and prosecutor Danette Meyers will meet in chambers with Judge Keith Schwartz ... Prosecutor - 0 LiLo -2, if your keeping score!

Lindsay Lohan Is Taking Plea Bargain

Lindsay Lohan's lawyer and the prosecutor have been trying to hammer out a plea bargain but have hit a wall, so now they're having a pow wow with the judge to break the stalemate.

0223_lindsay_leaving_EX_TMZ

Sources connected to the case tell TMZ ... Shawn Holley has been speaking with Dannette Meyers about copping a plea in Lindsay's felony grand theft case -- the whole necklace thing -- but Meyers won't budge on 6 months in jail.

So ... we've learned Holley and Meyers will go to court next week and meet with Judge Keith Schwartz in his chambers.  We're told Holley will ask the judge what sentence he'd hand down if Lindsay pleads guilty or no contest.

Sources familiar with the case and Judge Schwartz believe Hiz Honor would probably go for a 3 month sentence.

Our sources say both Meyers and Holley believe Lindsay will only do 20% of the actual sentence because of overcrowding.  So, if Judge Schwartz gave Lindsay 3 months, she'd only serve 18 days.

Judge Schwartz is known as a settlement judge, so it's likely a deal can be struck ... IF Lindsay's willing to accept reality -- that she's going to do some jail time, no matter what.

Stay tuned

Linsay Lohan Hoping to Get It Together Soon

Lindsay Lohan says she wants to be identified with great films in the future, not the personal problems and antics that have stalled her career in past few years.

"I don't want that to be what I'm known for anymore the tabloid stuff," she said Tuesday on the syndicated magazine show "Extra." Lindsay acknowledged that her comeback will not be an easy one.

"There's going to be a lot of steps that I have to go through to kind of prove myself again," she said. In the latest of her off-screen woes, Lohan is charged with the theft of a $2,500 necklace from an upscale jewelry store.

She has pleaded not guilty to that felony charge, which she did not discuss in the interview.

Lohan on Jimmy Kimmel in a Wonderful Infomercial!

On 'Jimmy Kimmel Live: After the Academy Awards', all of Hollywood's hottest babes revealed the exercise routine responsible for their svelte look: Jimmy K and his Hottie Body Humpilates technique. This is better than the Shake Weight.

Jessica Alba, Minka Kelly, Jessica Biel and Sofia Vergara were on hand to demonstrate in Jimmy Kimmel's infomercial, each humping an exercise ball (the "HoBo"). Dressed in red spandex, Jimmy K directed them: "Hump it up. Hump it down. Take a train to humpy town!" Eva Longoria revealed, "I couldn't stop humping! I hump everywhere -- at work, at the beach, in the car."

Lindsay Lohan appeared, hand in hand with Jimmy K, to give her full endorsement -- with the help of a lion. "Lions hump upwards of 40 times a night. I've spent thousands of hours watching them." Kimmel said, "The Jimmy K program is so affordable, it's practically a steal." Lohan chimed in, "Allegedly." Wink wink. You gotta love LiLo when life hands her lemons she makes freakin' lemonde!

Lindsay Lohan Going to Jail?

Lindsay Lohan just got the word from the judge that if she accepts a plea bargain, she WILL go to jail.

Judge Keith Schwartz Judge Schwartz did not say how much jail time Lindsay would do if she cops a plea. told the famous defendant bluntly, "I don't care that you're Lindsay Lohan." Judge Schwartz also wants a psychological evaluation that will help him understand what makes Lindsay tick and what particular sentence is appropriate.

The judge explained ... if Lindsay pleads guilty or no contest, it will be an automatic admission she violated her probation. Deputy D.A. Danette Meyers made a formal offer to settle the case.   Lindsay's lawyer, Shawn Holley, will noodle over the offer before deciding, but the judge indicated Lindsay's probably not going to accept the D.A.'s offer.  As we reported, Meyers wants significant jail time.

If Lindsay doesn't accept a plea, she'll stand trial and if she's found guilty she could get 1 year in state prison. Lindsay is back in court on March 10.  She has the option of pleading guilty and basically throwing herself at the court's mercy.

LiLo and Judge to Broker a Plea Deal that will include Jail Time!

The judge who will determine Lindsay Lohan's fate in the probation and grand theft cases will be the middleman in plea negotiations today between Lindsay and the prosecutor, and sources connected with the case says the judge thinks Lindsay should do time.

Lindsay will appear today before Judge Keith L. Schwartz, and sources connected with the case say that during the hearing prosecutor Danette Meyers will present Lindsay's lawyer, Shawn Holley, with a formal offer to plea bargain the case.

Sources tell us Meyers has already told Holley any deal will include significant jail time, but Lindsay steadfastly refuses to accept a plea that involves time behind bars.

Sources connected with the case tell us Judge Schwartz will propose that Lindsay accept jail time for the probation violation and three years felony probation for the grand theft case. But here's the BIG problem with that, if Lindsay gets in trouble during the probationary period, she'll go to state prison.

We're told Holley has not seen the surveillance video yet, but Meyers will present her with her very own CD tomorrow before the hearing. If Lindsay doesn't accept a plea, the judge will set a date for a preliminary hearing. The Plot Thickens!

Diana Knows Her Daughter Needs Help

Lindsay and Diana
Diana Lohan is speaking up about her 24-year-old daughter's constant troubles, which apparently have been plaguing LiLo since she turned 18 and moved to Hollyweird.

In an interview for 20/20 on ABC, LiLo's mom taked about her daughter's "lifelong struggled with addiction", life under a microscope, and the media's reaction to her most recent run-in with the law.

While discussing Lindsay's drug and alcohol problems, Momma Lohan said:
"I believe [that Lindsay doesn't drink anymore], and I think it's gonna be a lifelong struggle with addiction. But I think she's gonna be okay.
"She's a young girl struggling. You know, she's not perfect… She's learning as she goes, but she's learning under a microscope, so I can't even imagine how that is."
As for her most recent escapade at a Venice Beach, CA jewelry store? Dina doesn't think her daughter meant any harm. In fact, she says that she could "absolutely not" imagine her daughter being a thief.

Dina did, however, reveal that Lindsay has been in trouble for longer than we thought and began her downward descent only shortly after arriving to Los Angeles at the tender age of 18 when she started hanging with the fast crowd. Dina explained:
"I knew early on, I just didn't tell anyone about it. It was a personal situation."
"I never thought it would be this — the media would be so crazy. I really never thought it would get to this level. It's been really hard on my family, harder than anything."
Lindsay Get some help hun, and that is real talk, and YES I don't know you and I shouldn't, but I have heard to much about you to not see  there is a problem.

COULD LILO GO TO JAIL WITHOUT A TRAIL?

Lindsay Lohan could go to jail for more than a year for allegedly stealing that necklace ... and it could happen without a jury, without a trial .... without grand theft charges even being pursued.

After doing some investigating, we discovered the D.A. could drop the felony grand theft case completely.  But that wouldn't end Lindsay's legal woes -- not by a long shot.

Prosecutor Danette Meyers could go back to court and ask the judge to violate Lindsay's DUI probation ... on grounds she stole the necklace.

The judge in the probation case could then hold a hearing -- without a jury -- to determine if Lindsay did indeed pilfer the jewelry.

Now here's the big problem for Lindsay.  In a criminal case, the D.A. must prove guilt beyond a reasonable doubt -- in other words, convincing a jury that there's a 98 to 99% chance that she did the deed.

But in a probation violation case, all the judge has to decide is that it's more likely than not that she stole the jewelry -- in other words, that there's a 50.1% chance she did it.

Sources connected with the D.A.'s office tell us ... prosecutors believe they could ask for more than 1 year in jail if the judge decides Lindsay violated her probation.

And one final piece of bad news. It's very possible if the D.A. dismissed the grand theft case, the probation violation matter would go back to Judge Elden Fox in Beverly Hills, who has totally lost patience with Lindsay.

Are Lindsay Lohan and Samantha Ronson Back On? Do we Care? Sure We do!

Lindsay Lohan's relationship with Samantha Ronson has had its ups, downs and way downs, but it seems like things are on the upswing for the former couple.

The pair, who began dating in 2008, have had a number of very public breakups and makeups over the course of their rocky romance, one of which ended so badly that Ronson's family filed a restraining order against the 'Mean Girls' star.

It seems, however, that the two are in a good place these days, writing flirtatious Twitter messages to each other after Valentine's Day, with Lohan alluding to a romantic meal the couple shared.

This morning, Ronson went one step further to confirm their relationship status, tweeting, "watching grey's anatomy-my fav show-@lindsaylohan sleeping next 2 me- should i wake her up to let her know her mom is going on GMA?"

Although things got ugly betwen the pair for a while, Lohan has seemed intent on getting Ronson back since the first time the on-again, off-again couple split.

After Ronson "disappeared" from Lohan's life in 2009, the actress expressed hope that they would reconcile one day, telling Ellen DeGeneres, "I really care about Samantha, and we'll see what happens. Maybe when we're fully in the right place. And I love her."
